Terms of Service

Welcome to Fablespun. These Terms of Service govern your use of the fablespun.ai service, which is operated by Fablespun LLC, a South Carolina limited liability company ("we", "us", "our"). By creating an account or using fablespun.ai, you agree to these Terms.

1. The Service

Fablespun is a web application that uses AI to generate personalized children's stories and accompanying illustrations based on details you provide. Output is generated by third-party AI models and is not authored by humans. Fablespun offers two account types:

• Parent (free): Generate stories for your own children using a credit-based system.
• Teacher (paid subscription): Generate reading-practice stories tuned to a reading level, manage a classroom roster, and access educational artifacts (worksheets, lesson plans, comprehension questions). Subject to admin approval.

2. Eligibility

You must be at least 18 years old to use Fablespun. By creating an account, you confirm that you are at least 18 and that you are the parent or legal guardian of any children whose names or details you add to your account. Teachers additionally confirm they are acting in their professional capacity as an educator and have appropriate authority — through their school, district, or parent/guardian permission — to enter student first names and related details.

3. Your Account

• You're responsible for keeping your password secure.
• You're responsible for activity that happens under your account.
• Tell us at support@fablespun.ai if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Submit content that is sexual, violent beyond age-appropriate peril, hateful, harassing, or otherwise inappropriate for children.
• Use the service to generate content for harm, harassment, or deception.
• Attempt to circumvent safety filters or rate limits.
• Use automated scripts to scrape or abuse the service.
• Misrepresent your identity, claim to be a parent/guardian of children you are not, or claim educator status you do not hold.

We may suspend or terminate accounts that violate these rules.

5. User Content & License

You retain ownership of the stories and illustrations generated for you. By using the service, you grant us a limited license to process, store, and display your inputs (including character details, classroom rosters, and generation parameters) and outputs (including text, images, audio, and educational artifacts) as needed to operate the service.

6. AI-Generated Content

Stories, illustrations, audio, and educational materials are produced by AI systems. They may contain mistakes, inaccuracies, or content unsuitable for a particular child or situation. You are responsible for reviewing AI output before sharing it with children or using it in a classroom. We are not liable for AI errors.

7. Payments & Subscriptions

Parent credits: Credits purchased through Fablespun are non-refundable except where required by law. Prepaid credits do not expire unless we tell you otherwise.

Teacher subscriptions: Teacher accounts are paid monthly or yearly via Stripe. Subscriptions auto-renew at the end of each billing period at the then-current price unless cancelled. You can cancel at any time from the billing portal; cancellation takes effect at the end of the current paid period — no partial refunds. We may change pricing at any time with notice before your next renewal. For users in California, you may cancel a recurring subscription consistent with California's Automatic Renewal Law.

Payment card data is handled directly by Stripe; we do not store card numbers.

8. Teacher Accounts

Teacher accounts are intended for use by educators, librarians, reading specialists, and homeschool parents in connection with their own students or children. By using a teacher account you represent that:

• You have appropriate authority — through your school, district, or directly from a parent or guardian — to enter the first names, age ranges, and reading levels of students into Fablespun.
• You will not enter information about students you do not have authority to enter.
• You will not use student information in Fablespun for any purpose other than generating reading materials for those students.

Fablespun is not a school official, an authorized vendor under the Family Educational Rights and Privacy Act (FERPA), or a party to any school district data-protection agreement unless we separately sign one with you in writing. If your school or district requires a signed agreement before educational records may be shared with vendors, do not enter student information until such an agreement is in place.

9. Affiliate Links & Recommendations

Teacher accounts may include book recommendations or other links to third-party retailers. Some of these are affiliate links, meaning we may earn a commission if you make a purchase. Affiliate relationships do not influence the educational content we generate. Pricing is the same to you whether or not you use an affiliate link.

10. Intellectual Property

The Fablespun name, logo, software, and visual design belong to us. You may not copy, modify, or redistribute them without permission.

11. Termination

You can delete your account at any time from the account settings (or by emailing us). Deleting your account cancels any active subscription at the end of the current period. We can suspend or terminate accounts that violate these Terms, or for any reason with reasonable notice.

12. Disclaimers

The service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service or error-free output. Educational artifacts are starting points for instruction, not certified curriculum, and should be reviewed by the educator before classroom use.

13. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid us in the prior 12 months. We are not liable for indirect, incidental, or consequential damages.

14. Changes to These Terms

We may update these Terms. We'll post the new version at fablespun.ai/terms with a new "Effective" date. Continued use after changes means you accept them.

15. Governing Law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service shall be brought exclusively in the state or federal courts located in South Carolina, and you consent to the personal jurisdiction of those courts.
